What is the WDD Online System for?

Wrongful Dismissal Database Online is used by lawyers, human resources managers, employers or employees to determine the appropriate severance offer (the number of weeks' pay owed) to an employee being terminated without cause. Cases that have gone to court to arbitrate this issue have focused primarily on the employee's occupational category, age and years of service. Other factors include so-called "Wallace" damages, or additional notice based on mental distress suffered by the employee and determined by the court to have been caused by unwarranted actions on the part of the employer during the dismissal process. The latter can add significantly to the overall notice period awarded.

In calculating the average notice period in the cases surveyed, Wrongful Dismissal Database Online excludes those with additional awards (or reduced awards), as that would skew the result. However, users can opt to include these cases in the report by including "Special Circumstances" in the search criteria. The report provided will indicate why the award in each case was either significantly higher or lower than the average of those where no special circumstances were involved.

Where does the information in Wrongful Dismissal Database Online come from?

The database is not a complete archive of all unjust dismissal cases heard during the years covered by the database. The nearly 3,000 Canadian cases included in the database were selected by the author, Barry Fisher LL.B. for their precedent value; that is, their usefulness in determining how a Canadian court might rule in a current case with similar circumstances involved.

I purchased a report, but I lost the e-mail. Can get access to the report again?

Copies of your reports can be downloaded from the site for up to 14 days, even if you are not a subscriber to the site. To request an e-mail that contains a list of reports you have ordered as well as links to your active reports, click on the Report Options tab above, and enter your e-mail address in the space provided. A list of reports associated with that address will be generated and sent to that address, along with links that can be used to retrieve a copy of the report, make a modification to the report, or, if it was purchased using a credit card transaction, a copy of the receipt for the purchase of the report.

Can I get another copy of the receipts for an instant access purchase I made using my credit card?

The CogniLore Transaction Processing system allows you to request copies of receipts for all of your previous purchases at any time, even if you are not an annual subscriber. To view a list of receipts for your previous orders as click on the Report Options tab above and enter your e-mail address in the space provided. A list of reports associated with that address will be generated and sent to that address, along with links that can be used to retrieve a copy of the report, make a modification to the report, or, if it was purchased using a credit card transaction, a copy of the receipt for the purchase of the report.

How often is the information in Wrongful Dismissal Database Online updated?

The database is updated by the author on a continuous basis as new case transcripts are received and reviewed by the author according to the selection criteria previously described.

I'm looking for a specific case but it doesn't appear in any of my searches. Why?

Most likely it is because the case did not meet the selection criteria used by the author of the database. Remember, Wrongful Dismissal Database is not a complete archive of all unjust dismissal cases - just those that the author has determined have precedent value in determining the appropriate notice period in similar circumstances.

Why are my reports only available for 14 days?

The Wrongful Dismissal Database is continuously being updated, which means that the results for a specific set of terms can change over time. In addition, by removing old reports after 14 days, we keep the WDD Online system responsive to searches and requests. Note that while online availability expires after 14 days, you will still be able to continue to view and print downloaded versions of your report for as long as you keep the file.

Can I turn off the graphics on the reports?

No, the background watermarks contained within the PDF versions of the reports are there so that when you are viewing an electronic or printed copy of a report, you can be certain that it is a WDD Online article.
